1. Acceptance of Terms & Eligibility

By accessing or using our services, you agree to be bound by these Terms. You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use our paid services. If you are using the service on behalf of a company, you represent that you have the authority to bind that entity to these Terms. If you do not agree to all terms, you may not access the service.

2. User Accounts & Security

You are responsible for safeguarding the credentials used to access the service, including the security of your GitHub or Google accounts used for SSO. If you generate Developer API Keys, you agree to keep them confidential and not to expose them in client-side code or public repositories. We are not liable for any loss or damage arising from unauthorized use of your credentials or API keys.

3. Intellectual Property and AI Generated Content

Your Inputs: You retain ownership of the schemas, prompt descriptions, and configurations you submit to the service.

Generated Outputs: Subject to your compliance with these Terms, we assign to you all right, title, and interest in the outputs generated by the models based on your prompts. However, due to the generative nature of machine learning, outputs may not be highly unique, and similar data may be generated for other users. You may not claim exclusive copyright over generic AI outputs.

AI Limitations: The service utilizes models provided by third parties (such as OpenAI and Replicate). Generated data is strictly synthetic. It may contain factual inaccuracies, unintended biases, or fictional attributes. It is intended strictly for software testing, UI prototyping, and creative design purposes. It should never be treated as objective truth or used for critical decision-making.

4. Acceptable Use Policy (AUP)

You agree to use AI Persona Generator strictly for lawful purposes. You shall not use the service to:

• Generate fake identifying documentation designed to defraud or impersonate real individuals.
• Generate content that is explicitly unlawful, defamatory, hateful, abusive, or sexually explicit.
• Circumvent, abuse, or exploit our API rate limits, pricing constraints, or sub-processor safety guardrails.
• Scrape our systems or use the generated synthetic data to mass-train competing artificial intelligence models.

We reserve the right to immediately suspend or terminate accounts that, in our sole discretion, violate this AUP.

5. Payments, Subscriptions, and Refunds

Certain features, quotas, and APIs are provided via paid credits and subscription tiers processed securely by Stripe.

Refund Policy: Our operational costs are directly tied to API consumption by our third-party infrastructure (OpenAI tokens and Replicate compute time). Because these computational costs are instantly consumed and non-recoverable, we do not offer refunds for credits that have already been generated/consumed. You may cancel an active subscription at any time, which will take effect at the end of the current billing cycle. If you experience systemic technical errors, please contact support for review.

6. Disclaimer of Warranties

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that the generated output will meet your specific quality or accuracy requirements.

7. Limitation of Liability

In no event shall AI Persona Generator, its creators, or its sub-processors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; or (iii) unauthorized access, use or alteration of your transmissions or content.

8. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also revise these Terms occasionally by updating this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
